How to trademark a football team’s logo
Filippo Giacometti is a lawyer who specialises in trademark law.
He says trademark law is a complex area and requires an expert to advise.
“It’s very difficult to apply and the law is very complex,” he said.
“The law is designed to make it easier for individuals to use the mark, but in practice it means that the mark has to be protected by a trademark and in that way it is more complicated and it is difficult to get approval.”
This is why there are so many trademarks and so many different names that can be used in a team name.
“In a football club, they will sometimes change the name of their football team but it’s not always the case.”
In the United States, a football association has been granted the right to register trademarks with the US Patent and Trademark Office (USPTO).
However, in some countries, such as Argentina, there is no legal framework for registering trademarks, and only the USPTO has the authority to register marks.
“There is an ongoing debate around how trademarks are to be registered,” Giacommetti said.
“It is quite a big debate in Argentina.
For example, it’s very complicated.
For the club, you have to register your name with the federation.
The same goes for other sports clubs.
It’s very hard to make the case for trademarking a team’s name.
It can be very difficult and you can lose lots of money.”
Giacomettti said a number of clubs have had to change their names in the last five years.
“If you want to change your name, it takes time and the cost is a lot.
And then you need to put up a name with your team, but you have no idea whether the club will like it.”
So if you want your name to go, then you have an argument to the fans and they have to pay for it.
The club will then have to wait until they are ready.
“However, Giacometi said the US was beginning to make progress with trademark registration.”
A number of things are happening, the number of applications is growing, and the US government is starting to support it.
For some countries there are no laws for registering a trademark, but there is one for trademark registration in the US,” he explained.”
You can register a trademark but you cannot trademark the name, so it is very complicated.
“The number of trademarks registered by the US in Argentina has risen from 12 in 2016 to 17 in 2017.
The number is down from the early years, but Giacomteti said that was because the new owners had more time to consider the trademark application and they were less concerned about losing money.”
They are now willing to invest more and to give more time, which is good for business.
And I think it’s going to become a bigger issue,” he added.”
