Incontestably trademarked videogame ‘Super Mario Bros. 4’ in India
India has granted a trademark to ‘Super Nintendo 4’, which has already been used to trademark several other videogames.
Incontestables trademark is for ‘Super Donkey Kong’, a game released in 1992, while another, ‘Super Metroid’, is for a 1993 game called ‘Metroid: Samus Returns’.
Both games are also known as ‘Super Smash Bros’.
The two games are set to launch in India this month.
India has granted the ‘Super Super Mario Bros 4’ trademark to a local software development company, which had been granted it by the US Patent and Trademark Office in 2016.
It is a trademark granted by the Trademark office on November 18, 2017.
India’s patent office has not issued a trademark notice to Nintendo, which has been granted a ‘preferred’ trademark for ‘Nintendo 3DS’ since 2014.
According to an industry source, the US patent office is reviewing the trademark application for the ‘Nintendo Nintendo 3DS’, and is considering filing a response.
